New Judge To Rule On Removal Of Judge In Pharmacist Murder Trial

OKLAHOMA CITY -- Attorneys will be back in court this week in the murder case against a pharmacist Jerome Ersland who shot and killed a would-be robber.

Ersland's attorney Irven Box wants Judge Ray Elliott removed from the case. Box said Elliott used racial slurs against Hispanics and cannot be impartial.

Box appealed for another judge to rehear the motion to remove Elliott. The judge will rule on the removal on Tuesday.

Judge Tammy Bass-Lesure recused herself from the case last year.
