LAWTON, Oklahoma -- A former Oklahoma firefighter convicted of killing an Oklahoma Highway Patrol trooper has been sentenced to death for a second time.

Comanche County District Judge Mark Smith sentenced Ricky Ray Malone Monday during a resentencing trial Monday.

Malone shot Trooper Nikky Green in December 2003 after the trooper caught him operating a meth lab in a car in Cotton County. Malone was convicted and sentenced to death in 2005.

The sentence was overturned when Malone's attorneys claimed Malone suffered from a mental illness.
