Family: Record Of Noble Officer's Involvement In Boy's Death Erased

A family's 5-year-old son was accidentally killed by Noble police officers, who were trying to shoot a snake.

The officers were charged, pled guilty and received deferred sentences. But now the family has learned there's no record of one of the officer's involvement in the case.

Both Robert Shawn Richardson and Paul Bradley Rogers pleaded guilty to second-degree manslaughter for the accidental shooting death of little Austin Haley. Richardson received a 5-year deferred sentence, and Rogers received two and a half.

But now, there is no record of Rogers even being charged in this case.

Austin's father fears the former officer may get back into law enforcement, and be able to carry a gun now that his record has been expunged.

Austin's grandfather was with him when he was shot. He's also a lawyer and says he feels the officers have received preferential treatment.

We took that question to the Cleveland County DA himself who says there is another law on the books that says that you can.

The DA says there is nothing he or a judge can do about that.

Austin may be gone, but he is far from forgotten inside or outside his family's home.
