Trial Begins For Woman Accused Of Manslaughter, DUI

A trial began on Monday in Cleveland County, against a woman accused of causing a terrible car crash that led to the death of an 8-year-old girl.

A trial began on Monday in Cleveland County, against a woman accused of causing a terrible car crash that led to the death of an 8-year-old girl.

The accident happened along State Highway 9 back in September 2013. Kimberly Wenthold, 30, is facing charges of manslaughter and DUI as a result of that fatal accident.

Wenthold has been out on a $50,000 bond. She spent four days in jail following the accident. Monday was spent selecting a jury to hear the case against her.

Court records state that 8-year-old Cadence Gordon, her mother and aunt were driving westbound along Highway 9 when they swerved to avoid a head on collision with a car that had crossed the center median. That car was driven by Wenthold.

Though she was not involved in the deadly crash, she is accused of causing it, and faces charges of manslaughter and DUI.

Court records state her speech was thick and slurred, her eyes were glassy and her actions were delayed during her interview at the scene. They also state Wenthold advised officers she had consumed Xanax that day and tests were done to see what other drugs were in her system.

On Monday Wenthold appeared in court to finally stand trial in the case. Also in the courtroom were the grandparents and aunt of little Cadence.

Since they are on the witness list, they declined to speak on camera, but say they are glad this day has finally come. And say all they want is justice for Cadence.

News 9 did talk with the mother of Cadence Gordon by phone. She is also expected to testify but was not in court on Monday. She has also filed a civil lawsuit against Wenthold, seeking damages in excess of $75,000. That case is still pending.

The jury is being picked from a pool of 45 potential jurors. Opening statements are expected to begin on Tuesday.
