Courts Records Reveal More Details Into Luther Band Director's Relationship With Student

The Luther Public Schools band director, who resigned last month, is accused of having a sex with a 12-year-old student. Court records show the alleged inappropriate relationship went on for several months.

Just last week, search warrants show OSBI agents confiscated phone records, a laptop and multiple devices from the Luther band room. They belonged to Kyle Whitmus, the former band director at the center of a sordid investigation.

School is now out for Luther Middle School, but the investigation into Whitmus, the one-time band director for Luther Schools since 2009 is far from over.

Court records show since last November, a 12-year-old female band student said "Whitmus touched her hips, stomach, chest and grabbed her vagina and butt." The two kissed, and in January, they reportedly had sex in the music library after class.

They started texting each other and Whitmus told her multiple times not to tell anyone.

One text message from Whitmus reads:

"I feel like a pedophile though when I think of you like that and I'm not."

Other band students told investigators they kept the relationship a secret because the band teacher let them do whatever they wanted. Whitmus would turn on a movie really loud, while he and the student were in his office.

The girl told a counselor she had been struggling with depression, had an exacto knife to cut herself, and was upset because her brother had been deployed in the Marines and her parents fought constantly. The girl said she could confide in her teacher Mr. Whitmus, whom she had a crush on.

Rumors swirled around school that the girl was sleeping with the band teacher and having sex with other students her age. When asked why she was staying in the band room after class, the girl would tell her friends that her mother was going to pick her up and take her to lunch.

Court records state the girl's mother saw “unknown stains on her daughter's panties while doing laundry.” Investigators stated both the girl's parents work for the Oklahoma Department of Corrections.

Records show the Luther Middle School Principal verbally reprimanded Whitmus in 2012 after another female student was in his hotel room on a Dallas band trip.

Whitmus resigned on April 27.

Investigators say charges could be presented to the District Attorney as early as next week.
