Two weeks ago the defense attorney representing Albert Johnson filed a motion for continuance in his capital murder case.
According to the court document, Johnson's attorney wants his client to undergo psychological testing. He claims records obtained by Albert Johnson himself reveal he has a history of mental health problems.
Johnson's attorney has already authorized funding for psychological testing by a local neuropsychologist who has already agreed to conduct the tests, but cannot begin testing until at least late August due to prior commitments. The defense is also gathering evidence and interviewing Johnson's extended family, many of which live in Indiana, Missouri and Texas.
Johnson's attorney writes his client has already been consulted on the requests and agrees the case should be continued to allow the defense time to prepare. He claims he is prepared to personally waive his right to a speedy trial.
Johnson is accused of raping, beating and killing a woman inside his girlfriend's home in The Village June 13th, 2014.
The girlfriend was also badly beaten--- but survived. Her child, who was also asleep inside the house during the attack, was unharmed. Johnson's trial was scheduled to start in September.
The public defender is asking for Johnson’s trial to be delayed at least 6 months, so they can properly prepare for the trial once the psychological results are in.
Johnson's trial is now scheduled for February of next year.
