The biological father in a child custody case that went all the way to the U.S. Supreme Court is returning to Oklahoma.
Specialist Dusten Brown, who was scheduled to train in Iowa until August 21st, is traveling back home for a hearing concerning his daughter Veronica, according to Colonel Max Moss with the Oklahoma National Guard.
Moss said the Cherokee Nation District Court has scheduled an emergency hearing on Veronica Brown's guardianship that will be held in Tahlequah Monday morning.
Dusten Brown requested permission to attend the hearing and was voluntarily dismissed from the training, Moss told News On 6.
"Specialist Brown was not ordered to return to Oklahoma by his military commanders but did so of his own volition after consulting his attorneys," Moss said.
A representative of the Iowa National Guard had previously said Specialist Brown had been ordered home.
Brown is wanted for custodial interference in South Carolina. An arrest warrant was issued after Brown failed to transfer his daughter in accordance with court orders. A judge said Dusten Brown skipped the mandatory meeting, and did not send a proxy in his place, so he was ordered to immediately hand the girl over to Matt and Melanie Capobianco, her adoptive South Carolina parents.

The Sheriff's Office for the South Carolina county where the warrant was issued said they expected Brown to turn himself in on Sunday; however, his wife Robin told News On 6 they had never agreed to do so.

The Capobianco's attorney issued a statement on Sunday calling Brown's arrest "absolutely necessary to ensure that the rule of law is followed and a little girl is returned to her parents."
"Those who have physical control of the child are also actively assisting a felony -- including Robin Brown --who has declared that she will refuse to reveal Veronica's whereabouts to law enforcement and continues to vow not to comply with the law," the release states.
