The warden reportedly asked Patrick and two other anglers for their fishing license around 11:10 a.m. near Cookson Hills. He tried to take Patrick into custody after learning there was a warrant out for the fisherman's arrest, investigators say.

OSBI says the game warden fought his way up out of the water and fatally shot Patrick.

The OSBI is investigating the shooting and will present the Adair County district attorney will a report. The DA's office will then rule on whether the shooting was justified.
