Former Tulsa County Reserve Deputy Bob Bates is due in court Tuesday afternoon for sentencing following his conviction for second-degree manslaughter in April.

Bates has been held without bail since his conviction. The jury recommended a four-year prison sentence.

Bates's defense team requested a delay in Tuesday's sentencing so it can file a motion for a new trial. In that paperwork, attorneys attached a letter from juror # 24 to the judge, saying Bates doesn't deserve to go to prison and that the juror doesn't believe Bates is guilty.

The juror added the jury never agreed unanimously that Bates should get prison time.
