A jury was selected Monday for two brothers accused in what police say was a hit-and-run death.
Dakota Shriver and Gage Shriver are accused of murder, leaving the scene of an accident and other charges. They're both charged in a 2015 hit-and-run wreck that left Noelle New dead and her friend Maranda Talley seriously hurt.
Court records show the brothers had been drinking beer and were fighting over the radio when their truck struck the two friends.
Before jury selection began, the judge denied Dakota's attorney motion to dismiss the case on the argument that the district court doesn't have jurisdiction. His attorney argued that Dakota is Native American, and the crime he's accused of happened on Native American land.
The judge also denied Dakota's motion to push back the case.
