An alleged altercation between County Commissioner Kevin Calvey and a metro business owner could soon be a criminal case.

In a newly released sheriff’s department report in the August 19 incident, a plain clothed deputy said, “I observed Commissioner Calvey reach out with his right hand, make contact with Chad Whitehead's chest, and appeared to push him backward.”

The incident occurred as Calvey was meeting with reporters after the commission voted to send $44 million in COVID-19 relief funds to the county jail.

“This was the first time I've ever gone to a county meeting,” Whitehead said.

He said he reached out to Calvey and Commissioner Brian Maughan about their decision to use CARES Act money for the jail. Whitehead said he never heard back and wanted to hear Calvey’s explanation to reporters after the meeting.

“I held my hand out as a signal that a closed meeting was going to be occurring and the person just walked into my hand,” Calvey told News 9’s Scott Mitchell. “It's obvious from the video. It's ridiculous.”

“I'm a six foot five, 190-pound guy,” Whitehead said. “When I reviewed the video that the Black Times captured, you can hear my shoes squeaking. It was enough force to bring me to a stop.”

The police report said, “Commissioner Calvey applied force to Mr. Whitehead's chest causing his forward momentum to stop and his shoes to squeak on the floor. Mr. Calvey then closed the doors to the meeting room stating, ‘Not You’ prohibiting Mr. Whitehead and Mr. Baker from entering.”

According to the report, the investigation has been handed over to the district attorney’s office.

“This is not about me, this is not about what happened to me - I'm fine,” Whitehead said. “The bigger issue here is what are we expecting of our elected officials and what are we tolerating as a society. I guess I'm here to say that I expect better of our elected officials.”
