A man who admitted to killing his stepfather by giving him an “atomic wedgie” will go before a Pottawatomie County judge Thursday afternoon. That is when he will learn his sentence for the crime.
Brad Lee Davis plead guilty back in May to first degree manslaughter as part of a plea deal.
He originally was facing first degree murder.
On Thursday, Davis will learn if the judge will sentence him to a short prison term or long one.
He faces anywhere from four years to life in prison for the crime.
It was back on December 21, 2013 that he was arrested for the death of Denver St. Clair, who was married to his mother.
Court papers state Davis first claimed he was trying to defend himself during a fight with St. Clair inside his mobile home in McCloud.
Davis, who lived in the neighboring trailer, claimed St. Clair was drunk and was talking bad about his mom.
According to court documents, Davis admitted to giving his stepfather an “atomic wedgie” by pulling St. Clair's underwear over his back and head allowing the elastic band to wrap around St. Clair's neck.
In court, Davis said he never intended to kill his stepfather.
He says it happened in the heat of passion and admits the fight got out of hand and went too far.
In fact, Davis was the one who called 911 to report the crime.
The judge will hear from both the medical examiner and victim's daughter before handing down his decision.
St. Clair had just filed for divorce from Davis's mother three months before the deadly fight.
