A Seminole County man on Oklahoma's death row appeared in Muskogee federal court this week on a charge of Murder in Indian Country.

A Seminole County man on Oklahoma's death row appeared in Muskogee federal court this week on a charge of Murder in Indian Country, after a federal appeals court ruled the state lacked jurisdiction in the case.

David Magnan pleaded guilty to the killing of three people in Seminole County in 2004. He was sentenced to death but appealed.

The 10th U.S. Circuit Court of Appeals overturned his death sentence in June, ruling the crime occurred on Indian land.

During an appearance this week, Magnan entered a plea of not guilty in the deaths of James Howard, Karen Wolf and Lucilla McGirt.
