A McClain County judge ruled that a man on Oklahoma’s death row was inappropriately tried and sentenced in state court, based on the recent U.S. Supreme Court ruling on McGirt v. Oklahoma on tribal jurisdictions.

Shaun Bosse received three death sentences in 2012 for the murder of his ex-girlfriend and her two children.

The judge said because the crime occurred on the Chickasaw Nation’s land and the victims were members of the tribe, Bosse should have been tried in federal court.

At this time, Bosse remains in the Oklahoma State Penitentiary.
