3 Men Charged With Conspiracy, False Reporting Of Crime After OCPD Arrest Video Goes Viral

Three men were charged Wednesday with conspiracy and falsely reporting a crime after prosecutors said an arrest caught on camera was staged.

Oklahoma County District Attorney David Prater charged three men Wednesday with conspiracy and falsely reporting a crime after prosecutors said an arrest caught on camera was staged. 

According to a probable cause affidavit, Floyd Wallace conspired with Timothy Harper and Patrick Roth to lure Oklahoma City police to an area outside the Carver Correctional Center to make money on YouTube and go viral. 

The affidavit from police goes on to say Harper lied to dispatchers when he called to report Wallace was lingering outside. 

“There’s a guy hiding in the bushes ninja style, he might be trying to hide dope,” Harper said in a 911 call released by the police.

Prosecutors also said Harper told the dispatcher his name was Duncan Johnson. 

An officer and sergeant, believing the call was real, responded to the area off South May. Bodycam video shows the two try to determine Wallace’s name, whether he was on drugs, or having a mental health episode. 

The footage then shows Wallace repeatedly reaching into his pockets, against officers’ commands, and later approaching the sergeant. Police said the sergeant felt threatened, so he shoved Wallace to the ground and placed him under arrest.

Wallace, Harper, and Roth were also recording. All were using phones, while prosecutors said Wallace went further, using a camera embedded in sunglasses. 

The group are self-proclaimed First and Second Amendment auditors, who post videos online of their confrontations with police. 

Harper was arrested in 2019 after police said he walked into a restaurant where alcohol was served while carrying a gun.

The charge was dismissed.

 The current charges are misdemeanors. 

Wallace was jailed following the confrontation but bonded out. 

Warrants are active for all three of the men.
