The Oklahoma County District Attorney Vicki Behenna announced in July, that she's turning deadly officer-involved shootings to the multi-county grand jury to investigate. She followed up on that statement this week with a request to look into a shooting which led to a man being hospitalized.
Demetrize Carter was shot in the chest by an off duty Del City police officer during a Choctaw High School football game.
Carter's attorney Billy Clark said Carter was unarmed and looking forward to the first game of the season.
“Everyone in Oklahoma deserves to be respected. They deserve to be protected. He deserves an opportunity to do the things he wants to do. lawful things that anyone does,” Clark said.
Instead, the game ended in a deadly shooting and an officer involved shooting. The officer's attorney Gary James told News 9 in a previous interview his client didn't do anything wrong.
“It is a very justified use of deadly force. He didn't comply,” James said.
“You have to go into that particular incident within fact a valid threat against you or someone else. In this case there was nothing. A young man was killed we get that, but you can't go around shooting the first person you see,” Clark said.
The DA's office told News 9 another agency will hand over its investigation to the grand jury. News 9 has previously reported the Oklahoma County Sheriff's Office is investigating this officer-involved shooting.
“It's citizens in whatever jurisdiction you're in. There's usually a random selection of people,” Clark said.
The DA's office said the grand jury will recommend whether charges will be filed or not. Court documents said this investigation is confidential. It is strictly prohibited for motions, grand jury subpoenas, testimony to be disclosed to anyone outside of designated personnel.
