A man accused of killing an Oklahoma County deputy in 2023 is expected to appear in court on Tuesday.
Benjamin Plank is accused of killing Oklahoma County Sheriff's Deputy Bobby Swartz, and injuring Deputy Mark Johns as they served an eviction notice at a home in southwest Oklahoma City.
The Oklahoma County Sheriff’s Office said Plank opened fire on the deputies while they were serving an eviction notice last August injuring one officer and killing another.
Oklahoma City Police Chief Wade Gourley said Plank had planned to "kill any law enforcement that came to his house."
Plank drove away from the home, heading east on Interstate 40 before coming to a stop outside the main gate to Tinker Air Force Base where he was taken into custody.
The document said Plank believed members of his family and law enforcement were part of a part of a pedophile ring attempting to kill him.
The report said they found no records of Plank receiving mental health services, but they think with treatment he will become competent.
Following the shooting, the Oklahoma County Sheriff's Office said they are changing the ways deputies serve eviction notices to ensure their safety.
The court also ordered the state department to give counsel and the court an update on Plank's status every 90 days.
According to a mental health report, Plank does understand the nature of his charges, but said his mental state interferes with his ability to work with his attorneys.

Plank is facing several charges including first-degree murder and shooting with intent to kill.
