The U.S. Department of Justice sued Oklahoma City Public Schools in order to protect the rights of Air Force Reserve Senior Airman, Michael J. McCullough, under the Uniformed Services Employment and Reemployment Rights Act of 1994 (USERRA), according to the U.S. DOJ.
According to a release from the justice department, McCullough was employed by OKCPS in January 2022 and was told he would be able to return after being called to perform military service in February 2022.
The release also stated that a month into his deployment, McCullough was told by OKCPS that his contract for the 2022-2023 school year wouldn't be renewed.
McCullough says that OKCPS refused his requests for reemployment, despite there being available positions, according to the release.
The lawsuit seeks lost wages, other employment benefits, and liquidated damages, according to the U.S. Department of Justice.
OKCPS shared a statement following the lawsuit:
“OKCPS has been made aware of the lawsuit from the U.S. Department of Justice and our legal team is reviewing it. The district will work through the legal process accordingly. We cannot provide any further comment at this time.”
