Emmanuel Littlejohn, an inmate on death row in Oklahoma, was recommended clemency after making a final plea one month before his scheduled execution.
The Oklahoma Pardon and Parole Board had three members vote yes and two members vote no to grant clemency.
Littlejohn was sentenced to death for the 1992 murder of Kenny Meers, an Oklahoma City convenience store owner.
This vote comes after a response from Oklahoma’s Attorney General, Gentner Drummond, who has urged the board to deny clemency.
Drummond has characterized Littlejohn as a "violent and manipulative criminal."
Littlejohn was set to be executed on September 26.
