No charges are being filed against a man accused of a deadly shooting outside the Whataburger near 15th and Peoria.
Detectives say after reviewing surveillance video and speaking with witnesses, they believe the shooting victim, 30-year-old Eldon Mustin, may have been the aggressor in this situation.
Tulsa police were called out around 1:40 Wednesday morning to the Whataburger at 15th and Peoria in response to shots being fired. When officers got to the parking lot they found a man with multiple gunshot wounds and shell casings in the parking lot around him. He was taken to the hospital where he died forty minutes later.
Police said the shooter had left the scene, and they found him at his family home. He was taken to the detective division for questioning.
Police said they also interviewed witnesses and viewed the video of the incident.
Investigators said the victim of the shooting was armed and appeared to be the aggressor. Detectives say the victim and the suspect knew each other, but police have not released the names of the victim or the shooter.
"Apparently this was some kind of ongoing feud that spilled over here to the Whataburger," said Tulsa Homicide Detective Brandon Watkins.
