(Denver-AP) -- An appeals court judge in Denver has issued a warning to Oklahoma County prosecutors.

An Oklahoma City judge on the Tenth US Circuit Court of Appeals says that if Oklahoma County prosecutors continue to commit misconduct, valid convictions in death penalty cases might be jeopardized.

Judge Robert H. Henry says some prosecutors in the last 15 years have crossed the line in capital cases.

Judges from Lawrence, Kansas, and Denver agreed with Henry that former District Attorney Bob Macy made improper and irrelevant comments to jurors.

They were ruling on an appeal from Hung Thanh Le.

The court says Macy's misconduct was not sufficient to overturn Hung Thanh Le's death sentence.

He was convicted of the 1992 stabbing death of Hai Hong Nguyen in his home.
