Lawsuit Seeking CDC-Recommended Precautions At President's Tulsa Rally Denied

A lawsuit was filed and denied Tuesday afternoon in Tulsa County court, which asked the management company for the BOK Center to require face masks and social distancing at the President Trump rally Saturday night.

Attorneys are calling the Trump rally a "super-spreader," meaning they expect COVID-19 cases to jump after the event. Clark Brewster and Paul DeMuro said they were asking for a court hearing to get an injunction before Saturday's rally, which was denied.

"Such a collection of events would result in a super-spreader event that spreads the virus across northeastern Oklahoma and other places attendees go," Brewster said.

The suit was filed against SMG, the parent company of ASM Global.

They don't want to stop the rally, just for the management company to require masks and social distancing.

According to the lawsuit, "Plaintiffs seek limited relief based on Oklahoma's public nuisance laws. Plaintiffs merely seek a court order requiring ASM Global to institute appropriate social distancing protocols for the June 20 event, including the mandatory use of face masks and social distancing rules for all guests and employees, as recommended by state, local, and federal authorities, and by every credible and qualified medical expert who has studied this issue. Simply put, this court should order ASM Global to follow the same rules that any other individual or business desiring to host a mass-gathering indoor event in Tulsa County would be required to follow."

Brewster said he’ll have a team of researchers working on whether they can file an appeal for a hearing. He said they’ll make the argument that the BOK management group should require safety measures at the rally.

He said if they don’t appeal, then the lawsuit still stands, but becomes one that will be asking for money in damages if people get infected. He believes the amount could be in the millions.

Brewster said there is no political aspect related to the lawsuit for him, and he fully supports the president’s right to free speech. Brewster said exposing innocents is extremely reckless.

He said the campaign knows people are going to become infected or they wouldn’t require the waiver.
