Several people came forward Tuesday to testify they were with Glynn Simmons around the time of a Dec. 30, 1974, killing that took the life of a liquor store employee in Edmond.
Oklahoma County District Attorney is seeking a retrial for convicted murderer Simmons. Relatives and lifetime friends traveled from Harvey, Louisiana, to support the 69-year-old. He was convicted nearly five decades ago for the murder of Edmond liquor store employee Carolyn Rogers.
The judge asked to hear their testimony before making a ruling.
Oklahoma County prosecutors said last Friday the state made majors errors in Simmons' 1974 trial.
"There was a police report, a significant police report, that was not turned over. So we came to the conclusion because we believe in fair and just trials in Oklahoma that we should file an application requesting a new trial," said Oklahoma County DA Vicki Behenna.
Simmons attorney asked the judge Tuesday to dismiss the case with prejudice.
Behenna said that while there is very little evidence in this case, she believes Simmons should receive a new trial.
