The Oklahoma Court of Criminal Appeals has ordered a 30-day stay in the case of Michael Geiger.

Geiger is accused of raping and murdering a 2-year-old, but was recently found incompetent to stand trial by a psychiatrist.

The Oklahoma Court of Criminal Appeals is using the 30-day stay to see if the state can order its own mental health examination by a doctor the state chooses.

A report made in July from the Oklahoma Department of Mental Health and Substance Abuse Services said Geiger doesn’t comprehend his legal situation and isn’t mentally competent to help his defense in a trial.

Geiger was charged with one count of first-degree murder, one count of first-degree rape and one count of kidnapping.

Enid Police said Geiger kidnapped 2-year-old Caliyah Guyton at a motel while her family was asleep and sexually assaulted her in a nearby room.
