An Oklahoma federal judge ruled that a federal law prohibiting people who use marijuana from owning firearms is unconstitutional.
The case stems from a Lawton man arrested last year after being stopped with a loaded revolver and pot—he did not have a medical card but was working at a local dispensary.
His lawyers argue the portion of federal firearms law focused on drug users or addicts was not consistent with the nation’s historical tradition of firearm regulation.
Marijuana can be bought legally at more than 2,000 store fronts in the state and a vote to legalize recreationally is less than a month away.
